1. Who we are

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. We sell to customers with shipping addresses in the contiguous United States.

3. Products

Our products ship from stock held at our partners’ facilities in the United States. Availability for each style, color and size is shown on the product page. We try to show colors and designs as accurately as possible, but colors may vary slightly between screens and garment batches. The garment brand, materials and size chart are listed on each product page.

Our designs are original artwork. Gooberch is not affiliated with, licensed by, or endorsed by any author, publisher or other rights holder, and we do not sell official merchandise.

4. Prices and payment

All prices are in US dollars. The total price, including shipping, is shown at checkout before you pay. Sales tax, where applicable, is calculated at checkout. We accept the payment methods shown at checkout, processed securely by Stripe. We reserve the right to correct pricing errors and to cancel orders affected by an obvious error, with a full refund.

5. Orders

After you order, you’ll receive a confirmation email. We may cancel an order if a product is unavailable, if we suspect fraud, or if payment cannot be verified; in that case you’ll receive a full refund.

6. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Cancellations, replacements and refunds are governed by our Refund & Returns Policy. Both are part of these Terms.

7. Privacy

How we collect and use personal information is described in our Privacy Policy.

8. Intellectual property

All content on the Site, including designs, images, text and logos created by Gooberch, belongs to Gooberch LLC and may not be copied or used without our written permission. If you believe any content on the Site infringes your rights, email support@gooberch.com with details and we will review and respond promptly.

9. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, or to submit false information.

10. Disclaimer and limitation of liability

The Site is provided “as is”. To the fullest extent permitted by law, Gooberch LLC is not liable for indirect, incidental or consequential damages arising from use of the Site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits rights you have under applicable consumer protection law.

11. Governing law

These Terms are governed by the laws of the State of Colorado and applicable US federal law. Any dispute will be resolved in the state or federal courts located in Boulder County, Colorado, unless your local consumer law gives you the right to bring a claim elsewhere.

12. Changes

We may update these Terms from time to time. The “Last updated” date shows the latest version. Orders are governed by the Terms in effect when the order was placed.
